Terms and conditions

This family pass gives admission to a family of 4 (2 adults, 2 children 5-15) on a single day.

Not to be used in the October half term. Voucher expires 31st December 2022.

To use your voucher, just bring it to the Visitor Centre either on your phone or printed.

Normal opening hours are 10am - 4pm, however this is subject to change so please check directly with the Visitor Centre before making a special journey.

While stocks last. No refunds unless required by law. No cashback. Not to be used with any other offer.

Voucher Terms and Conditions

1 Application

These Terms and Conditions apply to the relationship between Radio Newquay and Media Ltd, (hereinafter known as Radio Newquay), its subsidiaries and customers.

2 Definitions

2.1 Commercial Partner means any individual, company, subsidiary or other entity that Radio Newquay, its subsidiaries and associated companies have a commercial relationship.

2.2 Contract means the agreement made between Radio Newquay, its subsidiaries and associated businesses and the Customer when the Customer completes the online purchase of Vouchers.

2.3 A Customer is a person who purchases a Voucher online through Radio Newquay, a subsidiary of or an associated business.

2.4 Radio Newquay means Radio Newquay and Media Ltd, its subsidiaries, associated businesses and commercially connected organisations, a company registered in England with company number and who's registered office 7 Chesterton Place, Newquay, England, TR7 2RU

2.5 Purchase Price is the price of the Voucher as stated on the Radio Newquay website's voucher scheme.

2.6 Service Provider means the entity providing the service from which the Voucher has been purchased (Radio Newquay, its subsidiaries and associated businesses).

2.7 Voucher means the voucher purchased online via the Radio Newquay website voucher scheme by the Customer.

2.8 Words used in the singular shall include the plural and vice versa.

3 Conditions of Purchase

3.1 The Customer is required to make his or her purchase of the voucher via the Radio Newquay website and to follow the instructions therein to complete their purchase of the Voucher.

3.2 Once the Customer has completed the online process, he or she shall have entered a legally binding Contract with Radio Newquay, its subsidiaries and suppliers and shall thus be bound by these Terms and Conditions.

4 Conditions of Payment

4.1 Payment for the Voucher must be performed by the Customer only by accepted credit or debit card as instructed online.

4.2 Payment of the Purchase Price is made online and must be completed prior to Radio Newquay processing the Customer's order.

5 Reservation of Proprietary Rights

The Voucher will remain the property of Radio Newquay until the Voucher has been paid for in full and received by the Customer.

6 Delivery

6.1 The Voucher will be made available electronically to the Customer until redeemed through the account setup when purchasing the voucher.

6.2 Radio Newquay reserves its right to refuse to accept orders from outside of the United Kingdom.

6.3 Should a voucher be destroyed or misprinted then Radio Newquay will endeavour to re-issue the voucher to the customer’s account. Please contact us for more information.

6.4 In any event that multiple vouchers exist then the first voucher to be presented to the service provider will be accepted regardless of whom made the payment. Multiple vouchers are regarded as invalid.

7 Termination of the Contract

Radio Newquay may refuse to complete a Customer's order in certain circumstances which include but are not limited to;
  i. typing errors on the part of the Customer;
  ii. where the Customer has any outstanding liabilities to Radio Newquay;
  iii. where the Customer has failed to pay the Purchase Price or any other fees due by them; or
  iv. where the Voucher is no longer available.

8 Refund Policy

Once purchased, vouchers cannot be transferred, exchanged, refunded or returned.

8.1 Should an establishment cease trading within the validity period then a refund will be issued. The Customer can obtain a refund by writing to and including a copy of the voucher to; Voucher Scheme, Radio Newquay, Unit 15 Prow Park, Newquay, Cornwall, TR7 2SX

8.2 Should an establishment withdraw its participation during the validity period then a refund will be offered to the customer. The customer can obtain a refund as per highlighted in point 8.1.

8.3 Refunds can only be granted under the following conditions:

  i. To the individual who purchased the Voucher;
  ii. To the same credit or debit card the Voucher was purchased on; and
  iii. Refunds cannot be given once a booking has been made, nor on expired vouchers.

8.3 Refunds cannot be given under any other circumstances.

9 Guarantee and Liability

9.1 Radio Newquay's liability is hereby limited to the value of the Voucher.

9.2 Radio Newquay is not responsible for the performance of the Service Provider and does not guarantee warrant or endorse the performance Service Provider.

9.3 Should the Customer not be satisfied with the performance of Service Provider, the Customer should direct their complaint to the Service Provider directly. 

10 Data Protection

10.1 Radio Newquay shall at all times comply with the provisions of the Data Protection Act.

10.2 The Customer states his or her consent for the use of Customer data for advertising purposes by Radio Newquay and the transfer of this data to the Commercial Partners of Radio Newquay when completing the order of the Voucher online.

10.3 By accepting these Terms and Conditions, Radio Newquay and their Commercial Partners may contact the Customer with information about products, services and special offers we feel the customer maybe interested in.

10.4 The Customer's right to revoke permission to collect, save and use their data is possible by writing to the designated data controller: Mark Chapple, Radio Newquay, Unit 15 Prow Park, Newquay, Cornwall, TR7 2SX

11 Governing Law and Jurisdiction

11.1 These Terms and Conditions shall be governed by and construed in accordance with the law of England and Wales.

11.2 The courts of England and Wales shall have nonexclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions.

12 Severance

12.1 You agree to settle any dispute or claim amicably.

12.2 Should any provision of these Terms and Conditions be found by any court or other competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extend required, be deemed not to form part of these Terms and Conditions and the validity and enforceability of the other provisions of these Terms and Conditions shall not be affected.

13 Amendments/Variations

Radio Newquay may change or alter these terms and conditions without notice at any time.
